1. Agreement and who may use the service
These terms are a contract between you and [registered business name] ("The Case Diary", "we", "us"), covering thecasediary.in, the web app at app.thecasediary.in and the Android app "Case Diary" (together, the "Service"). By creating an account or using the Service you agree to these terms and to our Privacy Policy. You must be at least 18 and legally able to enter a contract. If you use the Service for a chamber or firm, you confirm you have authority to bind it.
2. Your account
- You sign in with a mobile number you control, verified by a one-time code, and a password. Keep both safe. You are responsible for activity under your account; tell us promptly if you suspect misuse.
- An account is for one person. Each additional person in your chamber needs their own account and, beyond the free plan, a paid seat.
- The chamber owner controls who is a member and what each role (owner, associate, clerk) can do.
- Give us accurate information and keep it up to date.
3. Plans, fees and messaging charges

- WhatsApp and SMS messages that cost us money to send (for example hearing reminders) are billed separately, based on usage. Account-security messages such as one-time codes are not charged to you.
- Prices are in Indian rupees; GST and other taxes are added where applicable. We will give at least 30 days' notice before changing prices for an existing paid subscription.
- Payments are processed by a third-party payment gateway; we do not store card or UPI details. Online checkout is not live yet — until it is, paid plans are set up by arrangement with us.

- If your chamber moves from paid to the free plan, we will not delete your data. Features above the free limits may become read-only until you are within them or upgrade.
4. Your content and your professional duties
- You own the content you put in the Service — cases, notes, client details, fee entries, documents ("Your Content"). You give us a limited licence to store, process and display it solely to run the Service for you and the people you authorise.
- You are responsible for Your Content, for having the right to record it, and for your own professional and legal obligations, including client confidentiality under the Advocates Act, 1961 and Bar Council of India rules and applicable data-protection law. We act as your processor for client data as explained in the Privacy Policy.
- Do not upload anything unlawful, or content you have no right to store.
- Keep your own copies of important documents. We take regular backups, but the Service is not a substitute for your own record-keeping.
5. Sharing a case
You can create a link for one case and send it to someone. They must sign in and accept it before they can open the case, with the view or edit access you choose. You decide who receives a link and are responsible for that choice; anyone who holds a link and signs in can accept it unless you restricted it to a specific mobile number or email. You can revoke a share at any time, which ends that person's access going forward (we cannot recall what they have already seen or saved).
6. Acceptable use
- No unlawful use; no attempt to access another chamber's data or to break, probe or overload the Service; no reverse engineering except as the law allows; no automated scraping.
- Messaging features (reminders, share links) may only be used to contact people you have a genuine, lawful reason to contact. No spam, harassment or promotional bulk messaging. You must follow TRAI / DLT rules and WhatsApp's business policies, and we may restrict messaging if they are breached.
7. Third-party services and delivery
The Service relies on third parties such as SMS and WhatsApp carriers and platforms, an email provider, a hosting provider and the Google Play Store. Messages are sent on a best-effort basis; delivery and timing are not guaranteed. Do not rely on a reminder as your only way of knowing about a hearing.
8. Availability and changes
We work to keep the Service available and secure but do not promise uninterrupted or error-free operation, and there is no service-level guarantee. We may add, change or remove features, and will give reasonable notice of changes that significantly reduce functionality you rely on.
9. Our intellectual property
The Service, including the software, design, "The Case Diary" name and logo, belongs to us or our licensors. You get a personal, non-transferable right to use it under these terms. Feedback you send us may be used to improve the Service without obligation to you.
10. Ending the relationship
- You can stop at any time and delete your account in the app (Account → Delete account) — see Delete your account. Ask us beforehand if you would like an export of your data.
- We may suspend or end access if you breach these terms, if required by law, if payment is overdue after notice, or to protect the Service or others. Where reasonable we will give notice and a chance to export your data.
11. Disclaimers and limits of liability
The Service is provided "as is" and "as available". To the fullest extent the law permits, we do not give warranties of any kind (including accuracy, fitness for a purpose and non-infringement), and we are not liable for indirect, incidental or consequential loss, loss of profit or goodwill, or for any missed hearing, adverse order or professional consequence arising from reliance on information in or notifications from the Service. Our total liability for any claim relating to the Service is limited to the fees you paid us in the 12 months before the claim (or ₹1,000 if you use the free plan). Nothing in these terms limits liability that cannot be limited by law.
12. Indemnity
You will cover reasonable losses we suffer from third-party claims arising from Your Content or from your breach of these terms or the law, to the extent permitted by law.
13. Governing law and disputes
These terms are governed by the laws of India. Disputes are subject to the exclusive jurisdiction of the courts at [city]. [Optional: arbitration clause — seat, rules, language.] Please contact us first; most issues can be sorted out quickly.
14. Changes to these terms
If we make material changes we will update the date above and notify you in the app or by message at least 15 days before they apply (30 days for changes to fees). Continued use after that means you accept them.
